This TERMS AND CONDITIONS AGREEMENT sets forth the agreement between DIYeStores.com and each affiliate marketer. 

Please read this agreement carefully before joining the DIYeStores.com affiliate program. By joining the DIYeStores.com affiliate program, you signify your assent to this Terms of Use agreement. If you do not agree to the terms and conditions contained in this Terms of Use agreement, please do not join the DIYeStores.com Affiliate program.

By joining the DIYeStores.com affiliate program and promoting our service you are agreeing to abide by following terms & conditions (rules) set forth below:

Use Of Downloadable Software
DIYeStores.com does not permit the promotion of our service within downloadable software. This includes, but not limited to Browser Help Operators (BHO's), Search Bar Tools, Shopping Enhancers, Top Moxies, etc... Any affiliate that is discovered to be promoting our service in any type of software will have all sales reversed and their account terminated.

Trademarks and Copyright
All Web site design, text, graphics, software and other content, and the selection and arrangement thereof, are the property of DIYeStores.com or its licensors, and are protected by United States and international copyright law. All rights to such materials are reserved to their respective copyright owners. Permission is granted to electronically copy portions of this Web site for the sole purpose of promoting the DIYeStores.com Affiliate Program. Any other use of materials on this site, including without limitation reproduction for purposes other than noted above, modification, distribution, replication, commercial or other exploitation, or creation of derivative works, without the prior written permission of DIYeStores.com, is strictly prohibited.

Promoting The DIYeStores.com Brand Name
In order to maintain our integrity and recognizable brand name in the marketplace, we ask that all of our affiliates do not engage in any of the following activities:

• Mislead others.

• Operate or utilize a Web site or email link to Web sites that contain or promote any of these types of content: libellous, defamatory, obscene, abusive, violent, bigoted, hate-oriented, illegal, cracking, hacking or warez, or that offer any illegal good or service, or link to a Web site(s) that do so and/or.

• Engage in spamming, indiscriminate advertising or unsolicited commercial email.

• Engage in cybersquatting or typosquatting.

We reserve the right to terminate the affiliate relationship with you for violation of any of the above mentioned items at any time within our sole discretion with or without notice.

Payment Of Commission
DIYeStores.com will pay all of our affiliates on the 15th of the following month provided that the affiliates commission is $50.00 or greater. All commissions will be paid in USA currency. DIYeStores.com reserves the right to withhold any commissions it deems as fraudulent such as those being earned or obtained through the use of spyware, BHO's or any other commission altering software program.

Affiliate Commission can not be combined with client referral commission.

Applicable Law; Jurisdiction
This agreement shall be governed by and construed in accordance with the laws of United States without regard to choice of law rules. Each user agrees to submit to personal jurisdiction and further agrees that any cause of action arising from or relating to the use of this site or this agreement shall be brought exclusively in a court in Missouri, United States of America.
